These Terms of Service (“Terms”) govern your access to and use of the NextStep AI Inc. marketing website at nextstep.com and any related public-facing services (collectively, the “Site”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

Use of the NextStep product by an institution and its end users is governed by a separate written agreement, including a Master Subscription Agreement and Data Processing Addendum, between NextStep and the institution. Those agreements control over these Terms with respect to the product.

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Site. By using the Site, you represent that you meet this requirement and have the authority to bind any entity on whose behalf you act.

Some features may require an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at support@nextstep.com of any unauthorized use.

“NextStep” and the NextStep logo are trademarks of NextStep AI Inc. You may not use them without prior written permission.

If you send us feedback, ideas, or suggestions about the Site or the product, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them for any purpose without obligation. Do not submit confidential information unless we have a written agreement permitting it.

The Site may link to third-party websites or services. We do not control and are not responsible for their content, policies, or practices. Your use of third-party sites is governed by their own terms.

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEXTSTEP AI INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE.

OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). Some jurisdictions do not allow the exclusion of certain warranties or limitation of certain damages; in such jurisdictions, our liability is limited to the greatest extent permitted by law.

You agree to defend, indemnify, and hold harmless NextStep AI Inc. from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or connected with your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

These Terms are governed by the laws of the State of Washington, U.S.A., without regard to conflict-of-laws rules. The exclusive venue for any dispute arising under these Terms will be the state or federal courts located in King County, Washington, and you consent to personal jurisdiction there.

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date at the top of this page and, where appropriate, by additional notice. Continued use of the Site after the effective date constitutes acceptance of the updated Terms.
